Welcome to WhiskyBids. These Terms & Conditions (“Terms”) govern your use of our website https://whiskybids.com (the “Site”) and your relationship with WhiskyBids (“we”, “us” or “our”). By accessing or using the Site, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use the Site.
WhiskyBids is an online marketplace that connects buyers and sellers of whisky and related products. We facilitate listings, bidding, payments, and communication between users — but we are not the seller of any item unless explicitly stated.
To use our Site, you must:
Be of legal drinking age in your country
Have the legal capacity to enter into a binding contract
Not be prohibited from using our services under any applicable law
We may request proof of age or identity at any time.
To buy or sell on WhiskyBids, you must create an account and provide accurate, current, and complete information. You are responsible for safeguarding your login details and for all activity under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or are suspected of fraudulent or abusive activity.
When you place a bid or purchase an item, you agree to:
Enter into a binding contract with the seller if you win the auction or complete a buy-now purchase
Pay all applicable charges, including item cost, taxes, and shipping
Honour the terms set out in the listing
All bids are final. You may not retract a bid once it is placed.
If you list an item for sale, you must:
Ensure the item is legal, genuine, and accurately described
Comply with all applicable alcohol and shipping laws
Ship items promptly and securely after payment
Honour winning bids or buy-now purchases
We may remove listings or suspend sellers who fail to meet our marketplace standards or breach these Terms.
Fees may apply to certain actions, such as selling items, listing upgrades, or payment processing. Any applicable fees will be clearly displayed at the time of use or listed in our seller documentation.
We reserve the right to update fee structures at any time with notice.
Payments are processed through third-party providers (e.g. Stripe, PayPal). WhiskyBids does not store your payment details.
You are responsible for any taxes or duties applicable to your transactions based on your location or local laws. Sellers must ensure they comply with tax requirements in their jurisdiction.
Shipping terms are agreed between buyer and seller. Sellers are responsible for safe, timely dispatch and must comply with shipping laws related to alcohol.
International buyers are responsible for customs charges, import duties, and checking local regulations regarding alcohol shipments.
WhiskyBids is not a party to transactions between users. While we may assist in resolving disputes, we are not liable for issues arising between buyers and sellers (e.g. delivery issues, authenticity concerns, misrepresentation).
We reserve the right to suspend or remove users based on behaviour or dispute outcomes.
You must not use the Site to:
List or sell counterfeit, unsealed, damaged, or recalled items
Violate local or international alcohol laws
Engage in abusive, fraudulent, or misleading behaviour
Interfere with other users or the functioning of the Site
We reserve the right to take enforcement action including removing listings, suspending accounts, or reporting activity to authorities.
All content on the Site, including text, logos, images, and design, is owned by or licensed to WhiskyBids and protected by intellectual property laws. You may not use or reproduce any content without our written permission.
To the fullest extent permitted by law:
We do not guarantee the accuracy or availability of listings or user-generated content
We are not liable for any loss or damage arising from use of the Site or transactions between users
Our total liability for any claim arising out of or relating to the Site will not exceed the amount paid by you (if any) to us in the previous 12 months
You agree to indemnify and hold harmless WhiskyBids and its officers, directors, employees, and affiliates from any claims, losses, liabilities, and expenses arising from your use of the Site or violation of these Terms.
We may suspend or terminate your access to the Site at any time, without notice, if you breach these Terms or if we reasonably believe your behaviour is harmful to the Site or its users.
We may update these Terms from time to time. If we make significant changes, we will post a notice on the Site. Continued use of the Site after changes are made indicates your acceptance of the updated Terms.
These Terms are governed by the laws of your jurisdiction – e.g. “England and Wales” or “the State of Delaware” depending on your business registration. Any disputes will be subject to the exclusive jurisdiction of the courts in that region.
